Introduction to Our Terms and Services

The following terms and conditions of use (“Terms and Conditions”) are intended to set out the relationship between Secret Garden Media Ltd. (“us” or “we”), which is the operator of secrettelaviv.com (the “Website”), and the individuals and/or organizations seeking to make available information regarding employment opportunities in their organizations, on their behalf or other’s behalf (“you”). For the purposes hereof, “you” shall include any individual or organization accessing our Website in your capacity as an Employer.

By using our Website and its services (“Services”), you represent that you read the Terms and Conditions and agree to them. In case you do not agree to any of the terms here, please don’t use our Services.

In our Terms and Conditions and in all texts appearing on the Website, a singular language includes plural and vice versa, and male language includes female and vice versa.

Section headings in the Terms and Conditions are intended solely for convenience and have no significance in interpreting the contents of the text.

We may alter these Terms and Conditions from time to time. The use of the Services on the Website at any time constitutes your agreement to the updated and revised terms. We may, from time to time and without any liability, alter or terminate the services on the Website, in whole or in part, with or without notifying our users.

Our Services – Publishing Job Listings

Job Listings can be posted on our Website by Employers either manually, by choosing one of the “Post A Job” plans on our Website (Basic or Premier), each having its own features, or through the Applicant Tracking System (ATS) that you use.

Some of our services for Employers who wish to post Job Listings require the payment in advance of a fixed fee, as specified on our Website.

We may, in our discretion, alter the description and/or job requirements that you provide in a Job Listing. In addition, we may remove, in our discretion, any links and/or information that is not relevant to the job advertised in the Job Listing.

We use our best efforts to keep the job Listings on our Website up to date in a timely manner. Nonetheless, we assume no responsibility in the event that a Job Listing that you submitted is not posted on our Website, or if such Job Listing(s) are not up to date.

We assume no responsibility, and disclaim all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Listings, including the job descriptions and requirements that you provide in those listings.

We provide our users search options to narrow down Job Listings search results by job type categories. Such categories are created independently and entirely by us, and may not directly or accurately reflect the content of the Job Listings. In the event that you believe that a Job Listing is miscategorized, please let us know by contacting our support. However, we have the full discretion on the categorization of Job Listings, and we will make the final decision thereon. Should you disagree with our decision, you can remove the relevant Job Listing from our Website.

We are not recommending any Employer or any Job Listing posted on our Website. Some Job Listings may be highlighted on our Job Board and on Job Emails, if such feature has been acquired by the Employer.

All Job Listings that are posted on the Website in a manual manner remain on the Website’s Job Board for thirty (30) days, after which they expire. In the event that you acquire the Premier Plan, then following the expiry of the 30 days, the Job Listing shall become a regular Job Listing, unless you renew the Premier Plan. Job Listings that are posted on our Website through an Applicant Tracking System will remain on the Website until such time as these listings are closed by the Employer.

We reserve the right not to work with certain companies, at our sole discretion. In addition, we reserve the right to refrain from posting certain Job Listings and/or to delete Job Listings from our Website, at our sole discretion.

Applicants’ Information

The information submitted by job applicants on our Website, including their resume and contact information, is not exclusive to the Employer that received such resume and/or information, and we are have the unlimited right to use such information for our own promotional purposes, for the purpose of offering applicants similar jobs (with their permission) and for any other purpose that we pursue, in our discretion, subject to our Terms and Conditions and the Privacy Policy.

It is clarified that once a resume is transmitted to you via our Website, we have no control over the information contained in such resume, and we are not responsible in any way for your use of such information. If an applicant wishes to delete, modify, or maintain confidence over any such information, such applicant will apply directly to you and it is your responsibility to handle such requests.

Your Information

We reserve the right to store information and data about your organization (such as details of contact person, email addresses, telephone number, fax number, etc.) in our databases, in order to send you applications to your Job Listings. We may also send Employers, from time to time, emails containing marketing material and additional relevant material (please see “Sending Emails to Employers” below).

In addition, you hereby agree that your organization’s data will be stored on a database managed by us, and further agree that data stored in the database may also be used by us for purposes of statistical analysis.

We may publish the fact that you are using our Website for posting Job Listings, for promotional purposes.

Company Page

When you post a Job Listing on our Website, we may generate for you a Company Page. You understand that we may display publicly available information about your company on the Company Page, such as, for example, the company’s address, its mission, staff size, business partners and the like, as well as links to your company’s official website, Facebook and Instagram pages. In addition, we may display open Job Listings of your company that are posted on our Website at such time.

We assume no responsibility for any content appearing on your Company Page, including but not limited to, photographs and/or videos. Additionally, we assume no responsibility with respect to any malfunction in the operation of any link appearing on your Company Page.

You may request us to change the Company Page, and we will use our best efforts to accommodate such requests.

We reserve the right to close Company Pages at any time, without rendering notice.

Applications to Job Listings

We cannot confirm the accuracy or completeness of any application submitted in response to a Job Listing on our Website, or of other information submitted by any applicant, including, without limitation, such applicant’s contact details and work status. We assume no responsibility, and disclaim all liability for the content, accuracy, completeness, legality or reliability of any application to a Job Listing.

When an applicant applies for a job using our Website, we automatically send their application to the contact information provided to us by you. We cannot guarantee that such messages and applications will be delivered or received by you. We also do not guarantee that there will be no mistakes in the transmission or storage of the data. Please note that Job Listings may expire between the time that applicants submit their application and from the time it is received. We have no responsibility for delivering applications after a Job Listing’s expiration. In addition, we cannot guarantee the validity of the contact information provided by applicants. We also cannot guarantee that job applications do not pass spam filters, nor can we guarantee the technical capabilities of any third party sites, including but not limited to, the Applicant Tracking System (ATS) that you use.

Constraints on the Use of Our Website and Services 

You will refrain from posting on our Website any of the following:

  • advertising material and/or material of a commercial nature (which does not include, for the removal of doubt, the Job Listings);
  • content that infringes or may infringe the proprietary rights of others, including copyrights or trademarks;
  • any pornographic or sexually explicit content;
  • any content the publication of which is prohibited by the provisions of any law, including by means of a restraining order of a court;
  • any content that constitutes defamation of any person and/or entity and infringes his/its privacy;
  • any computer software, computer code or application that includes viruses, hostile software, malicious applications and the like;
  • passwords, usernames and other identifying information, which enable the use of computer software, digital files, websites and services that require registration or payment, free of charge or such registration;
  • any information of a disturbing, insulting, hostile, threatening, rude or racist nature or content;
  • any information that may mislead any third party;
  • any information that is contrary to the accepted rules of use of the Internet or that may cause harm to or harm Internet users in general, and to the users of the Website.

You undertake that any Job Listing and/or content that you may publish on our Website and/or through it will comply with the provisions of any applicable law. Without derogating from the generality of the foregoing, your attention is drawn to the provision of Section 8 of the Equal Employment Opportunities Law – 1988, which prohibits the publication of an advertisement regarding a job offer which is discriminatory under the provisions of the law. The advertiser, contrary to the provisions of the above law, does so at its own risk and will bear all the consequences.

During the process of uploading a file containing an applicant’s resume, we have no ability to examine all the uploaded files and therefore we are unable and will not perform filtering of content in order to ensure compliance with our Terms and Conditions.

You undertake not to perform through our Website and/or through information contained on the Website any action contrary to Amendment No. 40 to the Communications (Bezeq and Broadcasting) Law – 2008 regarding the sending of advertisements to third parties and/or any action intended to disrupt or interfere with any computer and communication systems, including our computers themselves.

If there is malicious and/or negligent use and/or any other offensive use by yourself and/or anyone on your behalf of the services provided by our Website, and/or due to a violation of our Terms and Conditions, you will indemnify us, our employees, directors, shareholders or who anyone on our behalf for any damage, loss, loss of profit, payment or expense (including attorney’s fees and legal expenses) that they incur arising out of such malicious and/or negligent use and/or any other offensive use and/or as a result of a violation of these Terms and Conditions.

Our Commitment

We take various efforts to secure our Website and its uninterrupted operation. In addition, we endeavor to provide you with job applications, in the automatic manner explained above. Nevertheless, the use of our Website is provided “as is” and we do not guarantee that the service is free of all disruptions and defects or that defects will be rectified or that the service or the server providing the service is free of viruses or other harmful elements.

We make reasonable efforts to market our Website, including efforts to increase the number of visits to our Website. However, we do not guarantee that the Job Listings posted on our Website will have any response as we are unable to predict whether and how the public will respond to the publications. Therefore, we will not be liable towards you or anyone acting on your behalf for any of the above responses, lack of responses, the identity of the respondents or any outcome arising from the Job Listing and/or the information transmitted to you. We will not be responsible for any use made by third parties of any information published on our Website.

Sending Emails to Employers

We may send you, from time to time, emails containing marketing material and additional relevant material.

You are entitled, at any time, to request us to unsubscribe you from these emails. We usually perform such requests within 3 (three) working days.

Intellectual Property Rights and Limitations on the Use of the Website

All copyrights and other intellectual property rights in our Website and the content contained therein, including texts, site design, layout, graphics, photographs, illustrations, site logo, site name, domain, technological information required to operate it, applications, computer codes and/or any other material contained therein belongs solely to us. You may use the Website and its services only for their intended purposes. No other use is permitted. You are not allowed to copy, retransmit, repost, duplicate, sell, make available to the public or display to the public, including in a framed, visible or implied manner, any content on the Website nor to republish in any manner any of the Job Listings on other platform(s), without our prior written consent.

By posting Job Listing(s) on our Website, you hereby give us the right, permission and license to use your name and/or trademarks (whether registered or unregistered), including by placing them on our Website, in email sent to our users and/or on other platforms such as Facebook and LinkedIn and/or on promotional material that we publish.


Without derogating from any remedy available to us under any applicable law and/or these Terms and Conditions, we may terminate the services we render you and/or your use of our Website, if you fail to meet any provision of these Terms and Conditions. No refunds will be granted in such case.


We disclaim any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, operability or availability of information or material displayed in or linked from our Website, including applicant’s resumes, or otherwise made available on our Website by us or third parties, regardless of whether paid for or used for free. We disclaim any responsibility for the deletion, failure to store, mis-delivery, or untimely delivery of any information, emails, attachments or material submitted by you and/or by applicants. We do not guarantee that the Website will always be error free, safe or secure. We further disclaim any responsibility for any harm resulting from downloading or accessing any information or material on our Website or on other sites or services on the Internet accessed through our Website and/or the any harm or damage related to the interview process that you perform to an applicant and/or to the engagement of such applicant by you or the termination thereof. Under no circumstances shall we be liable to you or any third party on account of your use or misuse of or reliance on our Website or through using our Website.

We further disclaim all liability for any technical malfunction of our Website, including but not limited to failure of any computer systems, servers or providers, computer equipment, software, failure of email delivery (including attachments), account login, or any other services provided by us as a result of technical problems or traffic congestion on the Internet or any third party website (including but not limited to Applicant Tracking Systems (ATSs)) or combination thereof, including injury or damage to your or to any other person’s computer or other hardware or software, related to or resulting from using or downloading any content in connection with our Website or services and/or as a result of our termination of the services for nay reason. Under no circumstances will we be responsible for any loss or damage to any content or personal injury or death, resulting from anyone’s use of our Website, services or third party applications, websites, software or content posted on or through our Website or transmitted to you or any interactions between users of our Website or services, whether online or offline.

Governing Law and Jurisdiction

The laws of the State of Israel shall exclusively apply to any dispute related to our Website and/or the services rendered thereby, without taking into consideration its choice of law rules. The sole jurisdiction for any dispute related to the Website will be the authorized courts in Tel Aviv, Israel.
